Terms of Use

1. Acceptance of terms
By accessing or using Markulate ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service. These terms apply to all users including teachers, instructors, and any institutional users.
2. Description of service
Markulate is an AI-assisted marking and grading tool that helps educators generate rubric-anchored marking suggestions for written student work. Markulate is currently in beta. Features may change, and the Service is provided on an "as is" basis during this period.
3. Educator responsibility
You acknowledge and agree that:
- Markulate provides marking suggestions only — not final grades
- You are solely responsible for reviewing, approving, and issuing all final marks to students
- You will not present AI-generated suggestions as your own independent assessment without review
- You are responsible for ensuring your use of Markulate complies with your institution's policies on AI tools
- You will obtain any necessary institutional approvals before uploading student work
4. Acceptable use
You agree not to use Markulate to:
- Upload content that violates any applicable law or regulation
- Upload personally identifiable student data beyond what is necessary for marking purposes
- Attempt to reverse-engineer, copy, or replicate the Service
- Share your account credentials with unauthorised users
- Use the Service in any way that could harm students, educators, or institutions
5. Ownership of content
You retain full ownership of all rubrics, student scripts, and content you upload to Markulate. By uploading content, you grant Markulate a limited, non-exclusive licence to process that content solely for the purpose of providing the Service to you. This licence does not extend to AI model training, commercial use, or any use beyond operating the Service.
6. AI limitations
You acknowledge that AI-generated marking suggestions may contain errors, inconsistencies, or inaccuracies. Markulate does not guarantee the accuracy of any marking suggestion. The Service is designed to assist — not replace — qualified educator judgment. You agree to review all suggestions before applying them.
7. Beta service disclaimer
Markulate is currently in beta. The Service may be interrupted, modified, or discontinued at any time. We will make reasonable efforts to notify users of significant changes but cannot guarantee uninterrupted availability during the beta period.
8. Limitation of liability
To the fullest extent permitted by law, Markulate shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to grading decisions made on the basis of AI suggestions. Your use of the Service is at your own risk.
9. Changes to terms
We may update these Terms of Use as the product develops. We will notify registered users of material changes by email. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
